A success fee added to hourly rates that would have been payable by a client had a CFA not existed is enforceable.  The success fee does not need to be calculated on the costs at risk but on what would have been payable if the CFA had not existed.  This judgment may have a considerable impact on the way Defendant organisations fund litigation in the future.  Please use the link attached to the case citation above to see this interesting judgment.
